Texas Business Case Summaries

  • Breach of Contract - The firm represented a local business that was being sued by ATT Yellow Pages over yellow page advertising.  ATT claimed that our client owed them for unpaid advertising in their directory.  Our client objected to their claim citing the fact that promised proofs were never privided and the salesman did not do what was promised.  Furthermore, our client claimed that the advertising contract was procured through fraud.  After a trial to the court, the judge ruled in favor of our client and against ATT.  ATT was also ordered to pay our client court costs.
  • Business dispute - Successful representation of business in dispute with former partners requiring former partners to fully withdraw and disassociate themselves from business.

  • Breach of contract - Successfully represented Real Estate Broker in the trial of a lawsuit for Breach of Contract against Defendants to whom client had loaned money. The Plaintiff was the seller's broker in a real estate transaction.  At the closing, he loaned the buyers money out of his commission payment so the transaction could close on time.  Afterward, the defendants refused to repay the loan.  The lawsuit went to trial in the District Court of Montgomery County, Texas with Michael P. Fleming as the lead lawyer and assisted by Jack Morman.  The trial resulted in a verdict for all the relief requested by the client including the full amount of the loan plus interest, costs and even repayment of all the attorney's fees.
  • Breach of Partnership Agreement -  Michael P. Fleming represented a real estate developer in a lawsuit against his former business partner.  With tens of millions of dollars at stake, the firm obtained a temporary restraining order against the former partner.  The case later settled at mediation on terms favorable to the client.
  • Property taxes - Jack Morman have represented may individuals and businesses in obtaining favorable settlements in protesting the property taxes levied against their property.
  • Breach of contract - Obtained summary judgment on behalf of client that had loaned money to business associate.
  • Construction dispute - Obtained summary judgment on behalf of construction company in dispute with subcontractor.
